Trump order threatens supervised consumption, reduction of misdeeds

President Trump threatens to retain funds from supervised drugs consumption sites and potentially to pursue criminal sanctions against them, offering his clearest position to date against the philosophy of the reduction of misdeeds and the marking of a significant climbing of his rhetoric on the consumption of substances and dependence.

The new position, announced in a decree on Thursday, is committed to ending the financing of “programs which fail to obtain adequate results, including so -called” misdeed reduction “or” safe consumption “which facilitates only the consumption of illegal drugs and its prejudices.”

The new policy has been unveiled in the context of a broader action which could allow the authorities more latitude to force sick people in treatment against their will. But Trump’s reduction Trump targeting is also remarkable. Philosophy comes down to the reduction of the negative impacts of substance consumption without requiring abstinence: for example, helping consumers of injection drugs to avoid HIV or hepatitis by giving access to sterile syringes.

Although certain forms of reducing misdeeds have won a degree of acceptance, others, such as supervised consumption, remain controversial. The practice, sometimes called “sure injection” or “safe consumption”, offers not only sterile supplies for drug use, but also supervision of professionals who can provide naloxone, rescue breathing and other sur-aveve techniques, if necessary.

Only three sites of this type currently operate in the United States: two in Manhattan managed by the non-profit organization OnPoint NYC and a third in the Rhode Island. Onpoint, which has exploited its “overdose prevention centers” since 2021, says its staff have reversed around 2,000 deafness of potentially fatal medicines over the past four years.

The decree seems to involve the point of view most directly. The site managed by Project Weber / Renew in Providence, RI, is explicitly authorized by a state law. According to the federal government’s online grant database, he received no federal dollar other than a single subsidy of $ 10,000 in 2020 at the height of the COVVI-19 pandemic.

However, the two New York sites in ONPOINT operate on a more fortuitous basis, having opened in 2021 with the blessing of the mayor of the time, Bill de Blasio, but without an explicit law of state establishing its legality. The executive decree has faced immediate criticism of progressive groups who defend on behalf of homeless people or who consume drugs.

“If this administration really seeks to reduce death by overdose and improve communities safety, it must have permanently adopted and finance what experts in public health are saying the work: misdeed reduction programs, overdose prevention centers and generalized access to voluntary and non -coercive treatment,” said Deborah Reid, a prosecutor of the legal health policy, in a declaration. “These programs save lives.”

OnPoint NYC did not immediately respond to the request for comments from Stat.

Trump’s executive decree twice implies misdeed reduction organizations: first by threatening to end Samhsa subsidies, and secondly, by ordering examinations of federal money for homelessness and housing programs which offer supervised consumption services or “knowingly distribute the drug tight”. We do not know how the administration defines the paraphernalia and if the language could potentially apply to less controversial harm reduction programs, such as organizations that only offer the exchange of syringes.

The second reference includes a threat to “provide civil or criminal actions in appropriate cases”. The federal government, going back to the first Trump administration, argued that supervised consumption sites violate a law commonly called “status of the Crack House”, which prohibits the exploitation of an installation “for manufacturing, distribution or use of any controlled substance”. Supervised consumption defenders replied that the aim of their operation is not to facilitate the consumption of drugs, but rather to prevent its potential damage, such as the transmission of the disease or death.

The executive decree reduces the heart of a fundamental debate in the world of drug policy: if the reduction in misdeeds completes efforts to help people abstain from drugs and get recovery, or undermine them. A section on the homeless programs called on organizations which “fail to promote treatment, recovery and self -sufficiency” – in other words, offering housing and reduction services without explicitly pushing participants to treatment and abstinence.

In a statement, the Ministry of Health and Social Services told Stat that the HHS secretary, Robert F. Kennedy Jr., was “entirely aligned” on the decree.

“It is absolutely essential that the federal funding provided by the American taxpayer goes to effective and common sense solutions that prevent people from the cyclic crisis and put them in a recovery life,” said Vianca Rodriguez Feliciano, agency spokesperson.

Some outdoor defenders have also hosted the new position, arguing that the reduction in misdeeds and “housing first” policies have gone too far.

“A kind of reform is necessary,” said Tom Wolf, a San Francisco residing in the recovery of dependence on opioids which opposed policies that promote the reduction of misdeeds to immediately encourage abstinence. “Trump essentially said that the federal government will no longer allow people to camp in the street and take drugs all day.”

The misdeed reduction programs argue that they help people who consume drugs to stay healthy and live, regardless of their desire to stop. Programs cite data that shows services such as the exchange of syringes are very effective in stopping the transmission of infectious diseases. Data from supervised consumption sites around the world also reliably show that it reduce drug mortality.

OnPoint underlines that its services are open to everyone and that although recovery is not the explicit objective, it is often the final result. Often, participants meet the organization because of their supervised consumption offer, but later benefit from the countless services it offers. Many take advantage of sterile syringes or smoking supplies first, then laundry, mail, hot meals and acupuncture, then dedicated case workers, medical care, before finally looking for a detoxification program or a drug for the consumption disorder of opioids, such as buprenorphine.

In an apparent coincidence, a Pennsylvania Federal Court rendered a decision Thursday which opened the door to a non -profit organization in Philadelphia to argue that its proposal to offer supervised consumption services is protected for freedom of religion. The non -profit organization, Safehouse, has sought to open a supervised consumption site since 2018, but has faced the resistance of local, state and federal government.

A panel of three judges of the 3rd Circuit Court of Appeals judged that Safehouse is free to assert that the supervised consumption offer would be protected by the law on religious freedom. The non-profit organization supported in previous legal documents that its Judeo-Christian values create the obligation to save lives and reduce damage. The first Trump administration fought the candidacy of Safehouse to open in Philadelphia, and the Biden administration continued to continue the federal trial when he was taken according to 2021.

“The opinion of the Court recognizes what we have always believed: the law guarantees our mission to preserve human life in an unprecedented overdose crisis,” Safehouse said in a statement.
